In consideration of being a vendor, service provider or other participant in one or more events conducted by Historic Morganton Festival, Inc., the
undersigned agrees to indemnify, protect and save harmless the Historic Morganton Festival, Inc. from all claims, liability or lawsuits, including
reimbursement of attorney fees in defending such claims and damage to real or personal property which arises out of, or results from the acts or omissions of
the undersigned or resulting from the activities carried on by the undersigned and its employees, agents and representatives. II. I acknowledge that I have
read the rules & regulations (found in the cover brochure) for the 2023 Historic Morganton Festival to be held on September 8 & 9 and will abide by them.
I understand that if I have violated any regulations, festival officials may terminate my participation without refund. I release the Historic Morganton
Festival, Inc., producers of the event, from any responsibility for theft, damage or loss
If the Historic Morganton Festival is forced to cancel any of the events due to the current, national, state, and county outbreak, a refund will be issued. You
and/or your organization are personally responsible to take any and all precautions set forth by the CDC, Health Officials, and State guidelines in order to
protect yourselves while volunteering, vending, or performing on the premises/footprint of the Historic Morganton Festival. By signing this document, you
recognize that you will be exposed to the public and many individuals and that there is no way that the HMF, Inc. can control the experience you will have by
working with us or being present at the Historic Morganton Festival on any day or given time. Your health will be fully your responsibility during the Historic
Morganton Festival. By agreeing to partner with the HMF, Inc. as a vendor, you agree to hold the HMF participants, directors, volunteers, employees, City of
Morganton, and all sponsors, from any responsibility for claims, losses, fees, damages, or expense. The Festival will not refund prepaid fees due to inclement
weather, government action, strikes, terrorism acts (including acts of domestic terrorism), or other matters beyond its control, including but not limited to
cancellation of the festival due to a direct result of a natural or unforeseen disaster which renders the festival unable to continue, whether for safety or
monetary purposes. Masks are required by all participants and attendees.
